“Alec Baldwin intentionally, without just cause or excuse, cocked and fired the loaded gun even though the upcoming scene to be filmed did not call for the cocking and firing of a firearm,” stated the lawsuit, which was obtained by The New York Times.

It goes on to say that Baldwin should have “assumed that the gun in question was loaded” until “it was demonstrated to him or checked by him that it was not loaded” and said Baldwin should not have relied on assistant director David Halls’ guidance that it had been a “cold gun.”

“Mr. Baldwin cannot hide behind the [a]ssistant [d]irector to attempt to excuse the fact that he did not check the gun himself,” stated the lawsuit, also obtained by Deadline.

The Los Angeles Times, citing two crew members it did not name, reported that five days before the shooting, Baldwin’s stunt double accidentally fired two live rounds after being told the gun didn’t have any ammunition.

A crew member who was alarmed by the misfires told a unit production manager in a text message, "We’ve now had 3 accidental discharges. This is super unsafe

In another dramatic episode on Saturday, Baldwin’s stunt double accidentally fired two live rounds after being told the gun was ‘cold’, witnesses told the Los Angeles Times.

The man was hit in the shoulder, while the woman was airlifted to the hospital for stomach surgery.

"Joel then vaguely remembers [Hutchins] complaining about her stomach and grabbing her mid-section. Joel also said [Hutchins] began to stumble backwards and she was assisted to the ground."

The bullet was removed from Mr Souza’s shoulder during surgery.

"The cameras captured Alec shooting but Halyna and Joel were behind the camera so I don’t think the cameras captured them being shot.”
However, “cameras, lights and props were damaged” from the gunfire with “broken glass was everywhere,” so it is unclear if the footage would be salvable.

Souza and Russell both told the sheriff’s detective that after camera operators walked off the Rust set, citing housing and pay issues, they were down to one camera, and it was not filming when Baldwin’s gun discharged.

"The scene did not call for Defendant Baldwin to shoot the Colt Revolver," the suit filed by Serge Svetnoy states.
