  1. Flynn’s “conviction” was nolle-prossed by the Justice Department, meaning that the DoJ would not contest Flynn’s appeal. This means that he was not finally convicted. This means that he was not convicted.
    The judge refused to accept the n-p, leaving Flynn hanging without a final dismissal. Rather than let Flynn have to fight with the judge, President Trump issued Flynn a pardon, which is insulting as the DoJ admitted that Flynn was falsely prosecuted from the beginning, having a guilty plea extorted from him by threatening to falsely prosecute one of Flynn’s family (son).

  2. The president cannot pardon himself as he has not been convicted of a federal crime. Article II, §II, clause 1; see Art. I, §III, clause 7.
    The president is not a pope who can grant indulgences in advance for sins not yet committed.
    The president cannot be prosecuted or convicted of any crime, except by impeachment, until he is not president any longer. Art. I, §III, clause 7.
    He cannot pardon convictions on impeachments either.
